| Houston, Texas - Dear Foreclosure Victim,
You had no choice but to pay or lose your home in a foreclosure action. You agreed to pay, but then they did not even let you know your house was going up for sale. How do you feel?
Are you ready to join a revolt and bring down these regimes? Is there even a chance to get you to testify to the congress that we must take away the power to foreclose by non-profit corporations - which is what enables this racket?
You are a victim of the largest organized crime gang in the United States- our homes are now under the control of these dictatorship-centered regimes. Why do we send our army 15,000 miles to end the tyranny of dictatorships - and let them roam free and prosper in our own back yards?!?!?!?!!!!
The racketeering HOA scam has played its game on you, my friend. A big management firm and your board of directors did this to "teach you a lesson" and make an example of you for the rest of the HOA inmates. Here is a lesson that shows "what living in a mandatory non-profit corporation private government system" means.
Above all other rules, you must pay the "protection money" to the collection agent with a pound of flesh if you are late with your payment. You pay them "To protect your property values". Rest assured that when a "member" steps out of line - such as not pay his dues on time - he shall be retrained and assimilated to the ways of the new Nazi regimes we cheerfully and knowingly accept as a part of Traditional American Values in 2004. We no longer have the freedom to contribute our money to a non-profit organization - which was once the concept behind most neighborhood organizations. Things have changed- the big developers now mandate dues payments, and allow the HOA law firms to write the rules that we "agree to" when we purchase our "dream home".
A big chunk of your dues payment would have gone to the management company who instigate these laws and enable the racketeers to bring these trumped-up fees and fines and foreclosure.
IS it clear yet?
IF so, then I hope you'll accept this invitation -
Welcome to the Revolution.
I hope you can find the strength to help outlaw this practice in the United States. These non-profit corporations shouldn't be allowed to tack on collection fees or legal fees - at least for 2 years.
In Texas, a bill was presented that would prohibit legal fees for collections unless you are over two years behind - and the HOA lobby fought fiercely against it. Because of some other issues with fleeing democrats in Texas, this Salvo missed in 2003.
They (CAI-Backed Lobbyists) claim that HOAs will collapse and property values will plummet if they don't hold the powers of extortion and instant fines and foreclosure without notice.
They testify to the legislature about this in the several states - Including California I'm sure - and whine to keep the extortion practices alive, even in places where the people clearly do not wish to support them with voluntary contributions- where there is no servicese provided except the collection of dues and foresloure if you don't pay. No parks, no pools, no nothing except perhaps a flower bed and a fence.
I've testified that they are a crime gang, and dubbed these lawyers and extortion racketeers "The CAI Bismarck", the largest organized crime gang since the Italian Fascist party.
Freedom from association is a basic human right (Article 20 of the universal declaration of human rights). These regimes have become big business - one of the largest extortion rackets ever in the history of the country. Every new American home must pay into the coffers or wind up on the wrong end of the legal tyranny you now experience. Manufactured Consent by promulgation of unconscionable contracts via the largest housing mills ever on earth.
By Civil conspiracy and as a collective single entity, the mandatory association management industry in collusion with the big housing mills draft unconscionable "contracts" and hide the details that I define as "Extortion agreements" inside the deed restrictions of all basic homestead-styled housing.
Every HOA contract is different in some way, so you need to get a copy of this contract that you allegedly agreed to when you bought your house to understand your own personal HOA regime.
You should be able to get a copy of the HOA's "Declaration of covenants & Conditions" at the county courthouse. You can also request a copy via the process outlined in property code 207 (found at the link below). There is apparently no requirement that a purchaser of property be served this information at closing unless they follow this process - clearly an overly burdensome process and one which protects the HOA racket from liability when the full disclosure of this alleged "contract" comes to light.
The Laws relating to Homeowners Associations were first introduced in Texas in the mid 1980's. They can be found at this link, under title 11, sections 201-209.
Well, I hope this helps, let me know what you think, I'd really like to get your opinion. Good, Bad or Ugly.
Rich
