Sacramento, California -

Letter to The California Governor Arnold Schwarzenegger

Dear sir,

My name is Thomas Radcliff, age 64, I have built my dream home at COPPER COVE LAKE TULLOCH HOME OWNERS ASSOCIATION, at Copperopolis, CA..

My three sons and I have been building my home for about 15 months. I have spent every penny of my savings, 401 K, I.R.A., and my credit union savings, building my dream home for my wife and myself. My wife, Anita, age 62, pulled her state savings to help with the costs.

During this time we had health issues, causing us to fall behind in one year's worth of association dues . The association put a lien on our house, for the amount of $207.50 in May of 2003.

The association turned the lien over to Coast Assessment Service Company, Garden Grove , California. . We received a notice from Coast Assessment and contacted them by phone, a verbal agreement was made to pay back dues.

On January 8th we received a 3 Day Notice that our Dream Home was sold at public auction on Dec 18th, 2003. for the Sum of $70,000.

Now our home belongs to Robert Vardanega, Alameda, California. .We have tried to contact Robert who seemed cold and callous and he said he could care less about my wife and me and hung up.

We were looking for a loan when we contacted the association, to pay off loans and costs. Now our home, appraised for $289,000+, was sold for $70,000. I am in the process of losing everything I have, and have nothing left.

California Civil Code says that this is legal. I feel it is not because I have no recourse. Does this happen all the time and is this right? What can I do? What can you do?
