Paulson cites housing as 'biggest risk'

Hank Paulson on Friday said that housing remained "the biggest risk" to the US economy, as new data showed construction of family homes dropping to the lowest level in 17 years. Speaking at a conference in Washington, the US Treasury secretary said that the correction in the housing market had "further to go", but that the US was "working through the excess inventory".The US administration has threatened to veto legislation passed in the House of Representatives that would expand the role of the Federal Housing Administration to allow up to guarantee up to $300bn (£153bn, €192bn) of mortgages at more affordable levels. The White House and many Republicans believe such a move would put taxpayers at risk in order to bail out speculators. While the plan being discussed in the Senate on mortgage relief is virtually identical to the House plan, it is likely to include a measure diverting money from a new affordable housing fund at Fannie Mae and Freddie Mac to pay for the refinanced mortgage plan, therefore circumventing the main White House objection.

AHRC.COM Under Siege. I consider AHRC.Com an excellent public action site devoted largely to helping homeowners battle evil homeowner associations. It also helps YOU get the word out about criminals in government or quasi-government abusing you. As with all good organizations who expose big crime in business or government, the perps and their lawyers want to silence the whistle blowers. Read the story below, and then JOIN AHRC (free) and use the web site to start publishing your news items. Wikileaks issues a call for all people of good will to support ahrc.com in their fight. Wikileaks will arrange for secure hosting and distribution of AHRC if the censorship suit is successful.

Brief letter to the Orange County Court court to protest no proper service judgment given to Peters & Freedman home foreclosure lawyers. Please take note: It has been brought to my attention by AHRC News Services that a judgment was issued against me, on or about October 27, 2005. However, I was never served any notification of the case, and have no idea of what it is I am accused of doing. I have contacted PETERS & FREEDMAN LLP, but they refuse to return my calls.

The wave of misery caused by America's sub-prime mortgage crisis engulfed more homeowners in April as foreclosures leapt by 65% year-on-year, adding to pressure on the White House to provide relief for stricken borrowers. Banks filed foreclosure papers on 243,353 US properties last month according to RealtyTrac, an online marketplace for repossessed homes. The housing market meltdown has been a factor in forcing one Californian city, Vallejo, to file for bankruptcy. Saccacio said: "Property tax bases are eroding, putting municipal budgets in peril." In Washington, a Democrat-led initiative to provide aid for homeowners will go before the influential Senate banking committee next Thursday. The plan would permit struggling borrowers to refinance their mortgages with loans backed by the US government. It would allow the Federal Housing Administration to stand behind $300bn (£155bn) in mortgages, at an estimated cost to taxpayers of $2.7bn. It was overwhelmingly passed by the House of Representatives last week as 39 Republicans defied their party's leadership by supporting it. But President Bush has vowed to veto the measure on the grounds that it amounts to a "taxpayer-funded bailout for lenders and speculators".

What would you do if you and your husband were in the middle of fighting the good fight against the tyranny of your homeowners association, when your husband was suddenly hospitalized, and during his hospitalization, your homeowners association's CAI lawyer got a judge to summon your husband to court to pay the CAI lawyer a $5,000 sanction -- when the CAI lawyer knew full well that your husband could not attend his deposition because he was in the hospital?

Mediachannel.org appeals to its readers and the independent media community to publicize this issue, appeal to the local press to cover it and to civil liberties groups to defend them. This is an issue of economic justice and free expression in the context of a national foreclosure crisis. A California website representing homeowners fighting against foreclosures and arbitrary actions by Homeowner Associations is at risk of being shut down in the same way that a muckraking whistle blower site, Wikileaks.org was removed from the internet by a California Judge until a public clamor forced him to reverse himself.

The law firm of Peters and Freedman with offices in Encinitas and Palm Desert, California, claim to represent several hundred homeowner associations. A number of homeowners have been investigating some of the practices of this law firm, especially when they conducted foreclosure sales on behalf of homeowner associations. An investigation of 5 foreclosures has the following in common. 1. The foreclosure sale was handled by David Peters of Peters and Freedman. 2. The notice of foreclosure sale was posted in a publication called Uptown Examiner. It has a circulation of approximately 165. 3. Each home was sold to the same attorney, Carlos Sosa. 4. The homes were sold at foreclosure for amounts ranging from $1400 to $7,000. The equity in each home was estimated to be between $150,000 to $300,000.

THE $140,000 PARKING TICKET IN A CALIFORNIA HOMEOWNER ASSOCIATION

Simon Freedman of Peters & Freedman, the attorney for the association, is quoted as saying that the association had a duty to enforce its rules. Of course, a homeowner association lawyer would say that. He stands to make a lot of money from the homeowners for that noble stance. If the Madigans' legal fees were $80,000, it is safe to assume that the homeowners paid at least that for Mr. Freedman to prosecute the complaint. That is $140,000 out of homeowners' pockets over a vehicle that was parked on the street. That is quite a hefty parking ticket. This law firm has been criticised by many homeowners in Southern California for being excesively litigious.

It has been a banner year for homeowner association foreclosure lawyers, Peter & Freedman. They have been collecting untold amounts from victimized seniors and homeowners who fell into their legal traps in Riverside County, San Diego County and Orange County. Hundreds of seniors in Desert Crest Homeowners Association, other associations and their families are fighting their liens and lawsuits. This month Peters & Freedman lawyers had fellow lawyer Michael Kim unsucessfully attempt to overcollect tens of thousands of dollars from homeowner victims they terrorized in lawsuits by giving judges legal bills that included billings from other cases.

Approximately 150 liens were filed on homes. One resident reports that each homeowner had to pay about $9,000 - $6,000 of which went to the law firm of Peters and Freedman. The total bill is estimated at about $1,350,000. But that is not the end of the story. CLICK HERE TO VIEW FOX 6 NEWS REPORT ON SAN DIEGO HOMEOWNER ASSOCIATION FORECLOSURES AND LAWSUITS BY PETERS & FREEDMAN. It is reported that about 50 seniors sold their homes at fire sale prices to local realtors in order to be able to pay the judgment. It is estimated that the realtors were snapping up $40,000 homes for $20,000.. Approximately 20 seniors died during this process.

Homeowners may think that when they go to court, the two sides will both calmly tell the truth, and then a judge will calmly make a ruling. The following story may give you pause for thought. This story shows that when a homeowner goes to court against certain types of lawyers, the homeowner has to be prepared for anything - including this dirty pool lawyering. Homeowners report that this seems to be particularly true of homeowner association lawyers. Truth seems to be first casualty of such lawsuits.
