HOA's create foreclosures, because they can. Attorneys that represent these organizations charge the Hoa 's legal fees first to file the foreclosure process. If the home-owner shows proof that the fees were paid then the attorneys still want the homeowner to pay hefty legal fees to retract the foreclosure. Abuse of Process, Extortion, Theft by Conversion. Banks and Lenders should lobby and make lawmakers aware that this is one of the reasons for far too many foreclosures. Insurance companies should look into creating policies to prevent homeowners from having their properties stolen from them .

Montclair Homeowners Association should have Offered Mediation

California State Legislature needs to make Mediation MANDATORY for disputes under $5,000

This is information about the lawsuit filed against us. Montclair homeowners association sued us over $235. Legal fees for both sides amounted to over $15,000. The judge states the case has no merit therefore there is no prevailing party.

This is an issue that should have gone to mediation under California Civil Code 1354 before it went to the courts. We discovered that the California Civil Code 1354 has a variety of loopholes that makes mediation not mandatory.

Ms.Tooker finds there are three associations collecting dues on her house when collection lawyer Debora Zumwalt sends her this letter telling her she was selling her house in two weeks to collect $405 owed .
