Summary: The Texas House Committee on Business & Industry is holding a public hearing for three (3) important HOA Bills on March 29, 2005. HB 2215 would prohibit an association from foreclosing a property owners' association's assessment lien unless the association first obtains a court judgment foreclosing the lien and providing for issuance of an order of sale.
Other Information: Bill Information: The following HOA related bills are being considered in this committee:

HB 873 - Relating to regulation by a property owners' association of certain displays on property in a residential subdivision.

HB 927 - Relating to the foreclosure of certain liens on real property. (Left Pending in Committee 3/1/05).

HB 1344 - Relating to regulation by a property owners' association of certain political signs. Scheduled for public hearing on 3/29/05.

HB 1446 - Relating to priority of payment relating to property owners' association assessments.

HB 1770 - Relating to the power of a property owners' association to levy certain fines. (Certain violations would require written notice by certified mail.) Scheduled for public hearing on 3/29/05.

HB 2215 - Relating to the operation of property owners' associations. "The bill would amend the Property Code as it relates to the operation of property owners' associations, including prohibiting, except as provided by a restriction created prior to September 1, 2003, an association from foreclosing a property owners' association's assessment lien unless the association first obtains a court judgment foreclosing the lien and providing for issuance of an order of sale." Scheduled for public hearing on 3/29/05.


HB 2535 - Relating to the right of redemption after foreclosure.

HB 2802 - Relating to a restrictive covenant, rule, or other prohibition regulating a homeowner's display of the United States flag.
