Summary: • Vithlani asks a judge (Judge Monroe) to label a homeowner/ his former employer defending himself against Vithalni's case for disputed attorney fees a "vexatious litgiant". Vithlani and tells another Judge (Monarch) presiding over the trial of the same homeowner/ his former client that he "has an interest in the case" just before the trial. (Judge Monroe them told the homeowner that Vithlani had been his student in Western State Law School.)

Dilip Vithlani represented a homeowner against
Larry Rothman before Orange County Superior Court Judge Brooks. He requested and was awarded $3,000. in sanctions. Rothman requested it be lowered to $500. and Brooks agreed to do so. - October 27. 2004.
Other Information: Dec 29, 2004 - Vithlani was hired by a homeowner to do defense and trial of a lawsuit that Palacio del Mar Homeowners Association and Peters & Freedman filed against the homeowner. He abandoned the homeowner on May 29, 2005 - four weeks before trial. He became abusive with the client after the client told him to report illegal activities by a Palacio del Mar board member Kenneth Ziebarth who was also a judge.

The client asked Vithlani to report misappropriation of association reserves, fraud and conspiracy in Palacio del Mar and the involvement of board member - Judge Kenneth Ziebarth who had masterminded the discriminatory lawsuit with Peters & Freedman.

Vitlani threatened to abandon the client saying Judge Ziebarth was the judge in a valuable Riverside case he was involved in and he was getting favorable rulings on that case from Ziebarth. He said if it meant his financial interests vs his client's he would have no hesitation in sacrificing the client's..

In the five months preceeding the trial Vitlani ran up a fee bill of $50,000.- about $10,000 per month, He was being paid monthly. Two weeks before trial he demanded an additional $40,000 within 48 hours as prepayment of additional fees he anticipated he would charge for the trial. He threatened to abandon the client if he was not paid the monthly balance plus $40,000 fee advancement for the anticipated trial . He abandoned the case when he was refused prepayment of future fees.

His retainer agreement with the client said he has no malpractice insurance and required binding arbitration in the event of a fee dispute. He then violated his own arbitration contract and filed suit against his client claiming " fee dispute" .
