Dear Governor Schwarzenegger:
Once again, I urge you to sign AB2598.
This is a bill to protect the individual HOA homeowner, not a bill to outlaw HOAs.
I understand the advantages many see in owning a home in an HOA: Security, aesthetics, and yes, even class distinction for some. The first two being the primary reasons most choose this lifestyle (quite desirable within the age we live), the latter, unfortunately, but realistically, being the primary reason for many.
I understand the appeal the HOA has for municipalities and county governments. They do, after all, save local government lots of tax dollars, in a post-Proposition 13 California where property taxes revenues decrease and local government expenses increase.
But don't you think it is a bit extreme, Sir, to forfeit the inalienable rights, granted by the Constitution of this great country to every citizen, when one buys a home in an HOA?
While, in some opinions, AB 2598 may not go far enough to protect the HOA homeowner, it is a step in the right direction. It at least will eliminate wrongful foreclosures for some now, while our legislators take a look at the issue more closely for possible further action in the future.
