IS THERE ANY ROOM AT THE INN?
The enclosed Christmas card is being sent to you by the homeowners of California.
You are the representatives of the people of this state. Californians believe that they are not being represented in an area that vitally affects their lives - namely, their homes. For too long, special interests have dominated the housing policy of this state. The voice of homeowners has been drowned by the flood of lobbying money from lawyers, developers and banks.
For instance, it is the California legislature which allowed the development of Common Interest Developments (CID's), codified it in the Sterling Davis act and subseqent legislation. This legislation has wreaked great havoc on the citizens of California. It has, among other things, sanctified:
- non-judicial foreclosure of homes where individuals have the awesome power to foreclose on other's homes without any court proceeding for even such paltry sums as $5, often falsely imposed
- individuals under the guise of being "board members" trampling on the privacy and integrity of homeowners on such issues as the type of flowers they can plant, or color they can paint their home.
- association lawyers raiding the reserves of homeowner associations for
legal fees to gild their own lifestyles.
- trade groups such as CAI/CLAC creating legislation for their own financial gain.
We, the homeowners of California, ask that you let our people go, that you free us from the greedy shackles of lawyers and power hungry individuals, who seek to enslave homeowners in economic and social prisons.
A long time ago, a child was born in a stable because the power structure had forced his parents to leave their home for its own bureaucratic purposes. The indomitable spirit that was born, however, would live to see the day when that power structure would crumble in ruins.
A home is a physical and spiritual need for every human being. It should not be a tool to amass wealth, or a means for lawyers to create an ever greater spiral of litigation and counter-litigation. Your oath of office pledges you to work for the people of California. You now have the opportunity to listen to the voice of the people, to craft legislation that truly protects the individual in his or her home. Listen to the people, listen to the voices of those who have suffered from your oppressive legislation. Reform the Assembly and Senate Housing Committees, remove the Herods and ban the lawyers.
The frailty, poverty and seeming insignificance of that first Nativity scene are its very strengths. The swagger, the deep pockets and puffed-up importance of those who currently oppress the homeowners of California are not those who can create a society of peace and harmony, which is the only type of society that can endure. Hence, when we wish you peace at Christmas, we hope you will pause and reflect on what will truly bring peace. The grasping hand never wins, only the helping hand does. Will you help to ensure that there is room at the inn for all?
